Defense Based Act (DBA)

Coverage is required for all U.S. contractors and subcontractors doing business on behalf of the U.S. Government overseas. Defense Base Act extends United States Longshore & Harbor worker's benefits to employees working on a military base/installation or under a U.S. Government contract. DBA Coverage should be factored into your client's contract bid and should not be addressed at the last minute. Pricing will vary depending on payroll, length of stay, type of assignment, region where work is taking place, among other considerations. Besides covering U.S. citizens, DBA coverage is required for third country nationals and local hires.


MANY GREAT OPPORTUNITIES NOW EXIST FOR YOU TO TAKE ADVANTAGE!!! Triggers for DBA - There are five provisions in the current version of the Defense Base Act that prompt coverage:

1. Any employee working on a military base or reservation outside of the U.S.

2. Any employee engaged in U.S. government funded public works business outside the U.S.

3. Any employee engaged in public works or military contract with a foreign government which has been deemed necessary to U.S. National Security

4. Those employees that provide services funded by the U.S. government outside the realm of regular military issue or channels

5. Any employees or any subcontractors of the prime or letting contractor involved in a contract like numbers 1-4 above


Coverage Issues - Failure to obtain DBA insurance carries stiff penalties. All government contracts contain a provision that requires bidding contractors obtain necessary insurance. Failure to do so will result in fines and possible loss of contract. The additional and most severe penalty is that employers without DBA coverage are subject to suits under common law wherein common law defenses are waived. In other words, the claimants or their heirs need only file suit and do not have to prove negligence. Lastly, all claims may be brought in Federal Court and are against the insured directly.

CAP guarantees assistance for a wide range of crises that directly impacts or has the potential to impact a member during travel. CAP members enjoy on-demand access to a dedicated 24/7 Crisis Response Center; where they can receive advice, and if necessary, coordinated response services to bring closure to crises during travel.

CAP covers crisis consultation , coordinated response services and indemnified losses, during a period of travel for the following crises:

  • Violent Crime - Any act or threat of violence to a CAP Member which causes, or is likely to cause, death or serious bodily injury. Examples include robbery, assault or acts of violence following a natural disaster.

Political Threat - Political Threat means political and/or military events which have created a situation in which a CAP Member is in danger of or has incurred serious bodily harm. Examples include violent protests, an attempted coup or cycles of election violence. Because CAP is not an insurance policy, there are no hard “loss” triggers, such as official U.S. State Department travel advisories to qualify for assistance.

Terrorism -Terrorism means an act, including but not limited to the use of force or violence and/or the threat thereof, of any person or group(s) of persons, whether acting alone or on behalf of or in connection with any organization(s) or government(s), committed for political, religious, ideological or similar purposes including the intention to influence any government and/or to put the public, or any section of the public, in fear.

Hi-jack - Hi-jack means the illegal holding under duress for a period in excess of six hours of a CAP Member while traveling on an airplane, vehicle or watercraft.

Disappearance - Disappearance means the complete and unexpected loss of contact during a period of travel for a period in excess of 48 hours. An example may include, going on a shore excursion during a cruise and not returning to the ship.

Blackmail & Extortion - For the purposes of this membership program, Blackmail and Extortion means the making of illegal threats specifically to a CAP Member to:

  • Kill, injure or abduct a CAP Member; or damage Property;
  • Disseminate, divulge or use Trade Secrets; By persons who then demand a     payment  as a condition of not carrying out such threats. Examples may include the threat to abduct, kill or injure a CAP member by a taxi driver while traveling unless a payment is made, or being stopped at a check point while traveling and told a payment is required to continue through the check point.

Wrongful Detention - Wrongful Detention means the involuntary confinement of a CAP Member by any person(s) acting as agents of or with the tacit approval of any government or governmental entity, or acting or purporting to act on behalf of any insurgent party, organization or group.

Examples may include, being stopped at a check point while traveling and arrested for no apparent reason, or being detained while attempting to enter a country without cause.

Kidnapping - Kidnapping means any event or connected series of events of seizing, detaining or carrying away by force or subterfuge of one or more CAP Member(s) by any third party for the purpose of demanding a Ransom. Example, while exiting a restaurant in São Paulo, Brazil a CAP Member is abducted and a ransom demand is made.
